FAQ's

  • When should I speak to a Divorce Lawyer?

Our advice is that you should seek legal advice as soon as possible when considering a Divorce.

In fact some of our clients are not yet ready to Divorce and are simply seeking early advice in order to weigh up their options and gain a better understanding of the Divorce process. Being prepared at an early stage can provide you with the confidence and reassurance to move forward at your own pace.

  • How much does it cost to get Divorced?

It is important to us that you have a clear understanding of costs to assist in helping remove some of the financial stresses divorce can bring offering you piece of mind.  We are pleased to offer our client’s a fixed fee divorce which is transparent from the outset ensuring that you will know exactly how much you will pay before the process begins without limiting any legal advice to you.

We offer fixed-fee divorces for both the Applicant and Respondent which have been considered in line with essential legal advice.

    – Applicant – Not Disputed – £650.00 plus VAT, plus the court fee

    – Respondent – Not Disputed – £350.00 plus VAT

Please note that unforeseen events or contested issues may involve extra work outside of the fixed fee agreement and which will be charged as per our hourly rate.

  • How long does it take to get a Divorce?

Under the no-fault divorce process in England and Wales, it typically takes a minimum of around 6 to 7 months to complete. This includes a 20-week reflection period followed by a further 6 weeks and 1 day before the Final Order is granted. However, while the legal divorce itself has set timescales, financial matters and arrangements for children may need to be resolved alongside it, which can mean the overall process takes longer depending on your circumstances.

  • Are Finances dealt with at the same time as my Divorce?

Divorcing your Spouse will not resolve your Finances, Divorce only ends your marriage legally.

Finances are dealt with separately.  See our Finances page for more information here.

  • Can I Divorce without a Lawyer?

Yes, you can Divorce without a Lawyer.  However, we always recommend seeking advice from a Divorce Lawyer as soon as possible.

The benefit in applying for a divorce yourself is of course the cost, in that as there are no lawyers involved, you will not be required to pay lawyer’s fees. The downside to dealing with the Divorce yourself, again is that no lawyer is involved and that the Divorce may not go as smoothly as planned.

Our Lawyers are Specialists in Divorce Law and have many years of experience in dealing with the complex issues which may arise.  In fact we see many clients return to us after trying, unsuccessfully, to deal with the matter themselves.

To apply for a Divorce yourself online, visit the Government website here:  https://www.gov.uk/divorce/file-for-divorce

When applying for a divorce a Court fee will be payable. However it may be that you are eligible for help with the court fee, see link here to check if you are eligible: https://www.gov.uk/get-help-with-court-fees

Here at Andrew Isaacs Law we recommend that you seek legal advice before getting a Divorce. We can offer a fixed fee consultation where you will be provided with tailored advice based on your own unique circumstances, without any obligation to start a Divorce.
