TOLATA Specialists in Hull

Does this sound like your situation?

Does this sound like your situation?

  • The house is in your ex-partner’s name, but you paid towards the deposit, mortgage or renovations
  • You owned a home together and cannot agree on selling it or splitting the money
  • Your ex is refusing to acknowledge your share, or telling you that you are entitled to nothing
  • You are worried they will sell or remortgage before you get anything
  • An ex-partner is claiming a share of a house that is in your name

If any of these apply, you may have a claim under the Trusts of Land and Appointment of Trustees Act 1996 (TOLATA), or grounds to defend one. Unmarried partners have no automatic rights to each other’s property, but contributions and agreements can create a legal interest. We will tell you honestly whether yours does.

Our specialist solicitors can advise on:

  • TOLATA claims to establish your share of a property
  • Defending a TOLATA claim made against your property
  • Forcing or preventing the sale of a jointly owned property
  • Proving a beneficial interest where the property is in your ex-partner’s sole name
  • Registering a restriction to stop a sale or remortgage during a dispute
  • Disputes over deposits, mortgage contributions and renovation costs
  • Recovering money you put into a former partner’s home
  • Cohabitation Agreements and Declarations of Trust to prevent future disputes

FAQ's

  • Do I have any rights if the house is in my ex-partner's name?

Possibly, yes. If you contributed to the deposit, mortgage or significant improvements, or there was a clear agreement that you would share the property, you may have a beneficial interest. A TOLATA claim allows the court to recognise that interest.

  • How much does a TOLATA claim cost?

It depends on how far the dispute goes, and we will not let you go in blind. At your first consultation we give you a realistic view of the likely costs against what you stand to recover, so you can decide whether it makes financial sense before committing to anything.

  • Can I stop my ex selling the house before this is sorted?

In many cases, yes. We can apply to register a restriction at the Land Registry, which prevents the property being sold or remortgaged without your interest being dealt with. If you are worried about a sale, contact us quickly.

  • Are Finances dealt with at the same time as my Divorce?

Divorcing your Spouse will not resolve your Finances, Divorce only ends your marriage legally.

Finances are dealt with separately.  See our Finances page for more information here.

  • How do I prove my interest in a property?

Evidence such as bank statements showing mortgage or deposit contributions, records of payments for renovations, and messages or documents showing what you and your ex-partner agreed can all support your claim. We will help you gather and present this.

  • Do I have to go to court?

Usually not. Most property disputes settle through solicitor negotiation or mediation. Court is the last resort, but if it is needed, we will represent you throughout.

  • Someone is making a TOLATA claim against my property. What should I do?

Do not ignore it, and do not agree to anything before taking advice. We regularly defend property owners against claims and can assess quickly whether the claim has merit and how best to respond.

  • Is there a time limit?

Generally, claims must be brought within 12 years of when you should reasonably have known about your interest. The sooner you act, the stronger your position, particularly if the property may be sold or remortgaged.
