FAQ's

  • Do I have any rights if the house is in my ex-partner's name?

    Possibly, yes. If you contributed to the deposit, mortgage or significant improvements, or there was a clear agreement that you would share the property, you may have a beneficial interest. A TOLATA claim allows the court to recognise that interest.

  • How much does a TOLATA claim cost?

    It depends on how far the dispute goes, and we will not let you go in blind. At your first consultation we give you a realistic view of the likely costs against what you stand to recover, so you can decide whether it makes financial sense before committing to anything.

  • Can I stop my ex selling the house before this is sorted?

    In many cases, yes. We can apply to register a restriction at the Land Registry, which prevents the property being sold or remortgaged without your interest being dealt with. If you are worried about a sale, contact us quickly.

  • How do I prove my interest in a property?

    Evidence such as bank statements showing mortgage or deposit contributions, records of payments for renovations, and messages or documents showing what you and your ex-partner agreed can all support your claim. We will help you gather and present this.

  • Do I have to go to court?

    Usually not. Most property disputes settle through solicitor negotiation or mediation. Court is the last resort, but if it is needed, we will represent you throughout.

  • Someone is making a TOLATA claim against my property. What should I do?

    Do not ignore it, and do not agree to anything before taking advice. We regularly defend property owners against claims and can assess quickly whether the claim has merit and how best to respond.

  • Is there a time limit?

    Generally, claims must be brought within 12 years of when you should reasonably have known about your interest. The sooner you act, the stronger your position, particularly if the property may be sold or remortgaged.
