Unlike married couples, unmarried couples have no automatic rights to each other’s property when a relationship breaks down. Many disputes arise when one partner is the legal owner named on the title deeds, but the other has contributed towards the deposit, mortgage payments or renovations. In these cases, you may have a claim under the Trusts of Land and Appointment of Trustees Act 1996 (TOLATA).
An example: Sophie and Mark lived together for ten years. Although the house was in Mark’s name, Sophie had contributed to mortgage payments and renovations. When they separated, Mark refused to acknowledge Sophie’s interest in the property. Sophie was able to bring a TOLATA claim to establish her share.
