Many disputes arise when one party is the legal owner (named on the title deeds), but another has a beneficial interest due to making financial contributions towards the deposit, mortgage payments, or renovations etc.  In such cases they may have a claim under The Trusts of Land and Appointment of Trustees Act 1996 (TOLATA).

An Example of a TOLATA Claim: Sophie and Mark lived together for ten years. Although the house was in Mark’s name, Sophie had contributed to mortgage payments and renovations. When they separated, Mark refused to acknowledge Sophie’s interest in the property.
